These Terms of Service ("Terms") govern your access to and use of HomeSkool, the K-12 AI tutoring service available at homeskooltutor.com (the "Service"), provided by HomeSkool ("HomeSkool," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
HomeSkool provides an online, standards-aligned AI tutor, lesson explainer videos, printable study guides, and related educational features for grades K through 12, in English and Spanish. HomeSkool is a learning aid and supplement. It is not a substitute for school, certified instruction, special-education services, or professional advice, and it does not award grades, credits, or diplomas.
2. Eligibility and Accounts
You must be at least 18 years old and a parent, legal guardian, or other authorized adult to create an account. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account, including use by the children you supervise. Notify us promptly of any unauthorized use.
3. Subscriptions, Billing, and Renewal
- Free trial. New accounts may start a 7-day free trial. If you do not cancel before the trial ends, your selected paid plan begins automatically.
- Plans. Paid plans are Family and Premium, billed monthly or annually. Current prices are shown on our pricing page. Annual plans are billed once per year.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price, using your payment method on file, until you cancel.
- Cancellation. You may cancel at any time from within the app via "Manage subscription," which opens your secure billing portal. When you cancel, your plan remains active until the end of the current paid period and then does not renew.
- Upgrades. You may upgrade from Family to Premium at any time; the price difference is prorated.
- Payments. Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the applicable fees and renewals.
- Price changes. We may change prices or plan features; we will give notice of changes before they apply to your renewal.
- Refunds. Except where required by law, fees are non-refundable, and partial periods are not refunded. Canceling stops future renewals.
4. Acceptable Use
You agree not to: (a) share, resell, or sublicense your account or the Service; (b) use the Service for any unlawful, harmful, or abusive purpose; (c) attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the Service or its systems; (d) misuse the AI tutor to generate unlawful, harmful, or infringing content; or (e) use the Service in violation of any applicable law or these Terms.
5. AI Tutor — Important Notice
The tutor and other AI features are powered by third-party artificial-intelligence models. AI can make mistakes and may occasionally produce information that is inaccurate, incomplete, or not appropriate for a given student. Treat its output as a study aid to be reviewed by a parent, guardian, or teacher, and verify anything important. The Service does not provide medical, legal, financial, or other professional advice.
6. Intellectual Property
The Service and its content — including lessons, videos, study guides, text, graphics, logos, and software — are owned by HomeSkool or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Service and to print or download study materials for your household's personal, non-commercial educational use. All other rights are reserved. You may not redistribute, publicly display, or commercialize our content.
7. Third-Party Services
The Service relies on third-party providers (including Stripe for payments and AI/voice providers for tutoring features). Your use of those features may also be subject to the providers' terms. We are not responsible for third-party services we do not control.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that content (including AI output) will be accurate or suitable for any particular educational outcome.
9. Limitation of Liability
To the fullest extent permitted by law, HomeSkool and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless HomeSkool from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
12. Changes to These Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where applicable law provides otherwise.
